This has reference to SEBI circular no. SEBI/HO/MIRSD/MIRSD-PoD-1/P/CIR/2023/95 dated June 21, 2023 and Exchange notice no. 20230621-20 dated June 21, 2023, on the subject “Trading Preferences by Clients”
In this regard, in consultation with SEBI and other Exchanges, it is clarified as under.
- With reference to para 6 of the aforesaid SEBI circular, it is clarified that opting out facility should be provided to new as well as existing clients, and negative consent should be obtained separately from clients in writing. Trading Member’s shall maintain records of such written negative consent provided by the clients for at least five years.
- Further, it is reiterated that for existing clients, Trading Member’s shall offer them access on all the active Stock Exchanges for the segments already opted by them, as a default mode.
Members are advised to take note of the above and ensure strict compliance.
