This is with reference to the communication received from the Registrars and Transfer Agents (RTAs) of Asset Management Companies (AMCs) in respect of guidelines on KYC mentioned in SEBI Master circular ref. no. SEBI/HO/MIRSD/SECFATF/P/CIR/2023/169 dated October 12, 2023.
It states that the said guidelines require every SEBI registered intermediary to obtain and verify the Proof of Identity (PoI) and Proof of Address (PoA) at the time of commencement of an account-based relationship. Portability of KYC across AMCs is allowed on PANs where KYC status is Validated. However, for PANs with KYC status as Registered, intermediaries are required to independently collect POA / POI documents from the investor and have the same uploaded to KRA. In the process, some challenges were faced while handling transactions received on PANs where KYC status is IN-PROGRESS or REGISTERED. Basis the guidance received from AMFI; the following changes shall be in effect from December 1, 2024:
- Transactions need to be accepted from clients where KYC status as per KRA records is ‘KYC VALIDATED’ for PANs of all holders.
- If clients are new to industry and KYC registration is in progress, then transactions shall be processed up to 5 days.
- If KYC status of PAN holders is KYC registered at the time of order processing, then any transactions received under existing folio shall be processed even after December 01, 2024. If investor PAN is already available in a fund new folio creation will also be processed.
- Relaxation given for NRI client on acceptance of transactions under KYC Registered status will be continued till April 30, 2025.
- Existing process for non-individuals shall continue.
Members are hereby advised to take note of the above and ensure that all clients registered on BSE StAR MF platform for demat and non-demat mode of investments should be ‘KYC VALIDATED’ before order placement to avoid rejection of transactions from AMCs/RTAs.
